Acceptance of Terms

The services that Pinky-Tech provides to you are subject to the following Terms of Use ("TOU"). Pinky-Tech reserves the right to update and modify the TOU at any time without notice to you. The most current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of our Web page (www.pinkycs.com) and also on the scan page of our platform. When we make updates to the TOU, Pinky-Tech will update the date at the bottom of this page. By using the website or the Platform after a new version of the TOU has been posted, you agree to the terms of such new version.

Description of Services

Pinky-Tech provides you with access to Pinky CyberSafe®, and product information ("Services"). The Services, including any updates, enhancements, new features, and/or the addition of any new Web properties, are subject to these TOU.

Personal and Non-Commercial Use Limitation 

Unless otherwise specified, the Services are for your personal use within your company and non-commercial use (no re-selling to third parties). You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services.

Content

All content included in or made available through the Services, such as text, graphics, logos, icons, images, sounds, music, digital downloads, data compilation, software, and documents is the exclusive property of Pinky-Tech or its content suppliers and is protected by the various applicable trade dress, copyright, trademark, patent, and other intellectual property and unfair competition laws in Kingdom of Sweden and internationally. All rights not expressly granted to you in this TOU are reserved and retained by Pinky-Tech or its licensors, suppliers, publishers, rightsholders, or other content providers.

Software

Any software that is made available on SaaS (Software-as-a-Service) or to download from the Services ("Software") is the copyrighted work of Pinky-Tech and/or its suppliers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software ("License Agreement"). An end user will be unable to access or install any Software that is accompanied by or includes an End-User License Agreement (EULA), unless he or she first agrees to the End-User License Agreement (EULA) terms. Third-party scripts or code, linked to or referenced from this website, are licensed to you by the third parties that own such code, not by Pinky-Tech.

The Software is made available for download solely for use by end users according to the End-User License Agreement (EULA). Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

Without limiting the foregoing, copying or reproduction of the software to any other server or location for further reproduction or redistribution is expressly prohibited, unless such reproduction or redistribution is expressly permitted by the license agreement accompanying such software.

Representations and Warranties

Software is warranted, if at all, only according to the terms of the license agreement. Except as warranted in the license agreement, Pinky-Tech hereby disclaims all warranties and conditions with regard to the Software, including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement. For your convenience, Pinky-Tech may make available as part of the services or in its software products, tools and utilities for use and/or download. Pinky-Tech does not make any assurances with regard to the accuracy of the results or output that derives from such use of any such tools and utilities.

Pinky-Tech and/or its respective suppliers make no representations about the suitability of the information contained in the documents and related graphics published as part of the services for any purpose. all such documents and related graphics are provided "as is" without warranty of any kind. Pinky-Tech and/or its respective suppliers hereby disclaim all warranties and conditions with regard to this information, including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement. in no event shall Pinky-Tech and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of information available from the services.

The documents and related graphics published on the services could include technical inaccuracies or typographical errors. Changes are periodically added to the information herein. Pinky-Tech and/or its respective suppliers may make improvements and/or changes in the product(s) and/or the program(s) described herein at any time.

Limitation of Liability 

In no event shall Pinky-Tech and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of software, documents, provision of or failure to provide services, or information available from the services.

Pinky-Tech shall not be held responsible for any consequences arising from your unauthorized use of scanning features, including suspension by infrastructure providers, legal action by third parties, or platform bans. All activity is logged and associated with your account.

Member Account, Password, and Security

If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Pinky-Tech immediately of any unauthorized use of your account or any other breach of security. Pinky-Tech will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Pinky-Tech or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.

No Unlawful or Prohibited Use

As a condition of your use of the Services, you agree not to use the Services in any way that is unlawful, violates these Terms, or causes damage to Pinky-Tech’s infrastructure or users. This includes actions that may disable, overload, or impair Pinky-Tech servers or connected networks, or interfere with the normal use of the Services by others. You may not attempt to gain unauthorized access to any Pinky-Tech systems, accounts, or networks through hacking, password mining, or similar means, nor may you obtain or attempt to obtain materials or information not intentionally made available. You also may not copy, alter, or attempt to modify any part of the Services or these Terms. Additionally, you may not use the Services to conduct or simulate penetration testing, vulnerability scanning, or other security assessments on systems you do not own or control, unless you have prior written authorization from the legal system owner. Scanning public-facing assets without permission may violate third-party terms of service and cybersecurity laws and will result in tracking and reporting your activity to relevant authorities.

Authorized Use of Security Scanning Features

If your account has access to security assessment or scanning functionality (including but not limited to vulnerability scanning or diagnostics), you agree to use such tools only on domains and digital systems that you:

• Own,


• Operate as a security practitioner, or


• Have received explicit, written authorization to scan from the system owner or administrator.


Unauthorized use of scanning tools on third-party systems is strictly prohibited. Pinky-Tech may suspend or terminate access without notice and reimbursement in response to abuse reports, provider escalations (ex. AWS), or detection of non-compliant behavior.

Users are solely responsible for ensuring proper authorization prior to initiating any scans. Pinky-Tech disclaims liability for actions taken against users as a result of misuse, including hosting account suspensions or legal proceedings initiated by affected third parties.
